CITY OF CENTRALIA
RECORD OF COUNCIL PROCEEDINGS
Tuesday - September 22, 2009 - 7:00 pm

Mayor Browning called the regular meeting to order at 7:07 p.m.

Pledge of Allegiance

Mayor Browning led the flag salute.

Attendance

Present: Mayor Browning, Mayor Pro-Tem Canaday, Councilor Coumbs, Councilor Thompson, Councilor Bates and Councilor Shannon.
        
Absent: Councilor Barrett.

1. Approval of Amended Agenda - As Presented

MAYOR PRO-TEM CANADAY MOVED, SECONDED BY COUNCILOR COUMBS, TO APPROVE THE AMENDED AGENDA AS PRESENTED...motion PASSED...6-0.

2. Comments by the Public on Non Agenda Items
 
Robert Tomlinson, Director of Jupiter Arts Center, addressed the Council and noted he was having a benefit concert on Saturday, September 26th at 7:00 pm.

Jack Tipping, Onalaska, addressed the Council and noted he would like to see the City of Centralia address an E-verify ordinance pertaining to illegal immigrants.

Stan Lupkes, Centralia, addressed the Council and noted his support to Mr. Tipping pertaining the E-verify Ordinance.
 
3. Proclamation/Presentations
 a. Constitution Week

Mayor Browning read the proclamation into the record declaring September 17-23, 2009 as Constitution Week and Rachel Anderson accepted it on behalf of Children of the American Revolution and Daughter’s of the American Revolution.

 b. Emergency Preparedness Fair - Chief Berg

Chief Berg addressed the Council and updated them on the upcoming Emergency Preparedness Fair that will be held at Fort Borst Park this Saturday, September 26th from 10:00 am until 3:00 pm.
    

4. Reports

Patrick Sorensen - reported that there would be a Twin City Project meeting with the Corps of Engineers and WSDOT on September 30th from 4-7 pm at the Centralia Middle School.

Councilor Shannon - had no report.

Councilor Thompson - reported he attended the 9-11 concert in Washington Park, a Fire Authority meeting, the Prime Lending ribbon cutting and Business After Hours.

Councilor Bates - reported he attended the Twin Transit and Flood Authority meetings and thanked the CDA for keeping the downtown busy during the Girls Night Out.

Councilor Coumbs - reported he attended a Fire Authority and Solid Waste meeting.

Mayor Pro-Tem Canaday - reported she attended the 9-11 concert in Washington Park,  Prime Lending ribbon cutting, an Auditor’s meeting, Centralia College Scholarship Awards, Lodging Tax Committee meeting, City Web page meeting and a Fire Authority meeting.

Mayor Browning - reported he attended the 9-11 concert in Washington Park and noted that the city has started working on the 2010 budget.

5. Consent Agenda
 a. Voucher Approval for September 22, 2009 #103541-103708 $1,046,161.78
 b. Payroll Approval for September 18, 2009 #123586-123617 and direct deposit

 c. Approval of meeting minutes for September 8, 2009

 e. Approval of rental agreement with Lowe’s HIW Inc at the Depot 
 f. Approval of small works bid award-Blocking Powerhouse Windows
 g. Approval of bid award-Yelm Hydroplant Forebay Slide Repair

COUNCILOR COUMBS MOVED, SECONDED BY COUNCILOR BATES, TO APPROVE THE CONSENT AGENDA AS PRESENTED...

In response to Councilor Shannon’s comment regarding if staff was aware that a private business owner was trying to rent space to Lowe’s (item 5e), Economic Development Director Polo Enriquez stated that he was not aware of that issue.  He added that Lowe’s has come to the City and had mentioned they were not successful finding space anywhere else that would not require a lease longer than they needed.  Mr. Enriquez negotiated with them for the open area at the Depot that was not being used. 

Mayor Browning called for a vote on the motion...motion PASSED...6-0.

6. Request for Tax Reclassification of portions of four parcels on Mayberry Road

COUNCILOR SHANNON MOVED, SECONDED BY COUNCILOR THOMPSON, THAT THE CENTRALIA CITY COUNCIL APPROVE THE REQUEST TO CHANGE THE TAX CLASSIFICATION OF THE ATKINSON  PROPERTY LOCATED AT THE END OF MAYBERRY ROAD...

Mr. Sorensen addressed the Council and updated them and reviewed the potential issues that may cause the denial of this request.  He noted that due to the property being in a flood plain and the unknown placement of the levees, there may need to be some studies done.  Councilor Shannon stated that he felt there was no valid reason the City deny this request. 

Robert Atkinson, son of one of the property owners, addressed the Council and gave background on the property, including past and present issues.  He noted that his mother was acting at the direction of the County on this reclassification due to their Christmas trees now being grown trees.  After brief discussion and clarification of some points of interest by City Planner Tammy Baraconi, MAYOR PRO-TEM CANADAY MOVED, SECONDED BY COUNCILOR SHANNON, TO AMEND THE MOTION TO ADD AFTER “TAX CLASSIFICATION”, “FROM OPEN SPACE AGRICULTURE TO OPEN SPACE TIMBER”...motion PASSED...6-0.

Mayor Browning called for a vote on the main motion as amended...motion PASSED...6-0.

7. Approval of Contract with Project A for the Development and Redesign of the Website
MAYOR PRO-TEM CANADAY MOVED, SECONDED BY COUNCILOR SHANNON, THAT THE CENTRALIA CITY COUNCIL AUTHORIZE THE CITY MANAGER TO ENTER INTO A CONTRACT WITH PROJECT A FOR THE DEVELOPMENT AND REDESIGN OF THE CITY’S WEBSITE...

Mr. Sorensen addressed the Council and reviewed the background on the proposed change to the City Website and noted that the contract had a not to exceed $19,110 and should be complete in 4-6 weeks from the start date.

Mayor Browning called for a vote on the motion...motion PASSED...6-0.


8. Approval of 2010-2011 Phase II Pass-Through Grant from DOE  
COUNCILOR SHANNON MOVED, SECONDED BY COUNCILOR BATES, THAT THE CENTRALIA CITY COUNCIL AUTHORIZE THE CITY MANAGER TO SIGN AND ACCEPT THE 2010-2011 PHASE II STORMWATER GRANT FROM THE STATE OF WASHINGTON DEPARTMENT OF ECOLOGY...

Mr. Sorensen addressed the Council and gave a brief overview of the grant and Stormwater Project Specialist Kim Ashmore added that it was a $50,000 grant with not matching fund requirements to the City to be used to implement and manage the stormwater program.
 
Mayor Browning called for a vote on the motion...motion PASSED...6-0.

9. Approval of a resolution relinquishing interest in Myrtle St   
COUNCILOR SHANNON MOVED, SECONDED BY COUNCILOR COUMBS, THAT THE CENTRALIA CITY COUNCIL APPROVE A RESOLUTION RELINQUISHING ANY INTEREST IN MYRTLE STREET, AN UNOPENED STREET, AS REQUESTED...
 
City Attorney Shannon Murphy-Olson addressed the Council and noted that this particular road was already vacated many years ago and this resolution is presented to the Council to abandon the City’s rights in this property. 

Mayor Browning called for a vote on the motion...motion PASSED...6-0.

10. Approval on second reading an ordinance regarding Stormwater Illicit Discharge Detection and Elimination  
MAYOR PRO-TEM CANADAY MOVED, SECONDED BY COUNCILOR COUMBS, THAT THE CENTRALIA CITY COUNCIL APPROVE ON SECOND READING AN ORDINANCE ADDING A NEW CHAPTER ENTITLED 15.37 STORM AND SURFACE WATER ILLICIT DISCHARGE DETECTION AND ELIMINATION TO THE CENTRALIA MUNICIPAL CODE AND REPEALING ORDINANCES AND SECTIONS OF ORDINANCES IN CONFLICT HEREWITH...motion PASSED...6-0.
