Tuesday, June 10, 2014

Mayor Canaday called the regular meeting to order at 7:01 pm. She noted there was a Special Meeting prior to the regular meeting to hold an Executive Session on Potential Litigation. There was nothing to report.

Councilor Gallagher led the flag salute.

Attendance

Present: Mayor Canaday, Mayor Pro-Tem Elmore, Councilor Coumbs, Councilor Anzelini, Councilor Ricks, Councilor Gallagher and Councilor Greenwood.

Absent: None.

1. Approval of Agenda - As Presented

COUNCILOR ANZELINI MOVED, SECONDED BY COUNCILOR RICKS, TO APPROVE THE AGENDA WITH THE ADDITION OF ITEM #9 EXECUTIVE SESSION TO DISCUSS LITIGATION...motion PASSED...7-0.

2. Comments by the Public on Non Agenda Items

Leona Nin Sander-Hunter, Centralia, addressed the Council and spoke against the homeowners having to pay for sewer due to the Scott Development.

3. Presentations

a. Lewis County Update - Commissioner Fund

Commissioner Fund was not present.

b. Save the Outdoor Pool - Josh Logan

Mr. Logan addressed the Council and reviewed the process so far on a grant they are seeking. He asked that the City officially earmark funds for the pool to better their chances with the grant.

4. Reports

Councilor Ricks - reported he attended a the workshop on streets.

Councilor Coumbs -reported on the tire event, thanked Pioneer West, the CDA and City staff for the beautiful flower baskets, updated on Summerfest and noted the passing of Bill Mason and Bill Conrad.

Councilor Gallagher- reported he attended the workshop on streets and spoke on a clean up event in downtown that would be on June 29th and the Billetproof Car Show on June 28th.

Mayor Pro-Tem Elmore -reported he attended the workshop on streets, Chamber Forum, Twin Transit, Sports Commission and noted that Chef's Night out was on June 21st.

Councilor Anzelini -had no report.

Councilor Greenwood - reported he attended the Lewis County Historic Museum meeting.

Mayor Canaday - reported she attended a Flood meeting, the workshop on streets, Mayor's meeting, Tacoma Rail, Chamber Forum, Southwest Washington Clean air, orchestra at the College and visited Mrs. Whites Enrichment Class.

Emil Pierson - reported on the progress of the Sports Complex.

c. Consideration of meeting minutes for May 27, 2014

COUNCILOR ANZELINI MOVED, SECONDED BY COUNCILOR COUMBS, TO APPROVE THE CONSENT AGENDA...motion PASSED...7-0.

6. Consideration of City Manager Employment Contract Amendment

COUNCILOR GALLAGHER MOVED, SECONDED BY COUNCILOR COUMBS, TO APPROVE THE CITY MANAGER EMPLOYMENT CONTRACT AMENDMENT...motion PASSED...6-1 (Councilor Anzelini). Councilor Anzelini noted his only objection was that he felt the City Manager should live within the City Limits not the Centralia School District.

7. Consideration of a resolution adopting the 2014 Parks & Recreation Plan

MAYOR PRO-TEM ELMORE MOVED, SECONDED BY COUNCILOR RICKS, TO APPROVE A RESOLUTION ADOPTING THE 2014 PARKS & RECREATION PLAN...motion PASSED...6-1 (Councilor Anzelini).

8. Consideration of second reading of an Ordinance amending CMC Section 13.04.310 Hydroelectric and Light System

COUNCILOR GALLAGHER MOVED, SECONDED BY COUNCILOR ANZELINI TO POSTPONE THIS ISSUE ONE MEETING...motion FAILED...3-4 (Councilor Ricks, Councilor Coumbs, Mayor Pro-Tem Elmore and Councilor Greenwood).

MAYOR PRO-TEM ELMORE MOVED, SECONDED BY COUNCILOR COUMBS, TO APPROVE ON FIRST READING AN ORDINANCE AMENDING CMC SECTION 13.04.310 HYDROELECTRIC AND LIGHT SYSTEM ...

MAYOR PRO-TEM ELMORE MOVED, SECONDED BY COUNCILOR ANZELINI, TO AMEND THE MOTION TO ADD THE FOLLOWING WORDING TO 13.04.310 "IN ACCORDANCE TO CMC 13.04.150" IN TWO AREAS...

WOULD THEN READ AS FOLLOWS:

13.04.310 Access to premise.

In the course of conducting official business, authorized employees of the light department, with proper identification and after reasonable attempt to make contact with the tenant or owner during non-emergency situations, shall have access to all parts of a premise in accordance with CMC 13.04.150. If city employees are refused access per CMC 13.04.150, it shall constitute a violation of this chapter and may result in penalties as outlined in CMC 13.04.290.

Mayor Canaday called for a vote on the main motion as amended...motion PASSED...5-2 (Councilor Anzelini, Councilor Gallagher).

9. Executive Session to discuss Litigation pursuant to RCW 42.30.110(1)(i). Expected to last 15 minutes with nothing to report after.

COUNCILOR ANZELINI MOVED, SECONDED BY COUNCILOR RICKS, TO GO INTO EXECUTIVE SESSION TO DISCUSS LITIGATION PURSUANT TO RCW 42.30.110(1)(I) EXPECTED TO LAST 15 MINUTES WITH NOTING TO REPORT AFTER...motion PASSED...7-0.

The Executive Session was called to order at 7:58 pm and City Attorney Shannon Murphy-Olson was present. The Executive Session adjourned at 8:13 PM with nothing to report.@
